Nail Salon Ventilation Systems
New regulations will take affect for all new Nail Salons as announced by NYS Governor Andrew M. Cuomo to protect workers and customers from the harmful and dangerous contaminants used in Nail Salons by October 3, 2016. Existing Nail Salons licensed prior to October 3, 2016 will have an additional 5 years to comply with this requirement.
These new requirements, based on the 2015 IMC, will make mandatory a source capture system at each manicure and pedicure station that will exhaust 50cfm per station directly to the outdoors without any recirculation. The inlet of the exhaust will be required to be located not more than 12 horizontally and vertically from the point of chemical application. The exhausted air is to be discharged so that none of the harmful vapor, fumes, dust, and contaminants will enter any adjacent spaces. A make-up air system will be required to replace the ventilated air which will place an additional load to the cooling and heating requirements of the space and should be considered in its design.

Ventilation Systems Required In New York Nail Salons
As part of the New York governor’s initiative to reform laws protecting workers in the nail salon industry, mechanical exhaust systems with at least one inlet at each nail station are required in every salon. The law applies to both existing salons and new salons salons licensed before October 3, 2016 have up to five years to put a system in place. The state guidelines are based on the 2015 International Mechanical Code, used by many industries within the United States.
The 2015 International Mechanical Code states that “Manicure and pedicure stations shall be provided with an exhaust system in accordance with Table 4.03.1.1 Note h. Manicure tables and pedicure stations not provided with factory-installed exhaust inlets shall be provided with exhaust inlets located not more than 12 inches horizontally and vertically from the point of chemical application.”

Citing the economic impact of the pandemic, Gov.Kathy Hochuls administration is postponing for six months a rule requiring nail salons to install ventilation systems to help prevent manicurists and customers from inhaling harmful chemicals used in nail products.
Its the second time the state has delayed the date of implementation during the COVID-19 outbreak.
The first postponement was issued last October.
Due to the pandemic many businesses were required to close or significantly reduce capacity which resulted in economic losses. As a result, some businesses are not able to meet the existing deadline and would be potentially forced to close, the Department of State said in reporting the delayed implementation in the NYS Register.
Extending the current deadline by 6 months will help businesses remain open, recover losses and come into compliance with existing requirements, while also protecting employees from potential job losses.
The nail salon owner must pay the costs to install the ventilators.
Nail salons were given five years to comply with new air filter edict, first announced in 2016.
State Attorney GeneralLetitia James made workplace safety in nail salons a top priority when she previously served as the New York City public advocate.
She issued a report in 2014 titled, How Safe Is Your Nail Salon? and complained about an inadequate number of inspectors to check on them.
New Ventillation Regulations For Nail Salons In New York State
Governor Andrew M. Cuomo announced that all nail salons in New York State will be required to have ventilation systems in order to better protect both technicians and patrons. Beginning October 3, 2016 all new nail salons will be required to comply with the 2015 International Mechanical Code which contains specific ventilation requirements for nail salons and other businesses that provide nail services such as salons.
The code specifies the following regulations for nail salons:
- Supplying fresh outdoor air sufficient to remove all chemicals, vapors, fumes, dust and other air contaminants from the salon and exhaust them safely to the outdoors.
- The ventilation systems must assure that no exhaust air will be recirculated into the salon or into any other space in the building where the business is operating.
- The code also requires specific exhaust systems at all manicure and pedicure workstations.
In a statement on the Governor of New York State website, Governor Cuomo said “These new regulations will make nail salons in New York the safest for employees and consumers anywhere, and are yet another example of our administrations commitment to protecting vulnerable employees and making workplaces across the state safer.

The new rule is among the most sweeping changes in the states initiative, more than a year long, to make the industry safer and more equitable for workers, many of whom say they suffer ill health effects as a result of their jobs.
Any nail salon that opens on Oct. 3 or later will have to have a ventilation system. Existing salons will have five years to comply.
The expense of installing new ventilation will be borne entirely by salon owners, Alphonso David, the counsel to Gov. Andrew M. Cuomo, said in an interview. Some salon owners have challenged previous new salon regulations as financially burdensome for small businesses.
Immigrants take some of the most dangerous jobs and are exposed to conditions that can literally kill them, if not destroy their health, Mr. Cuomo, a Democrat, said in a statement. We focused on the nail salon workers who, as a class, have been grossly exploited and exposed to dangerous chemicals without any protection. These new ventilation requirements will make nail salons in New York the safest in the nation.
